We aren’t sure why Trump is so mad, he’s about the only one who would be left with a job.
On Friday, the New York Times and NBC News released reports that prosecutors have warned the Trump Organization attorneys that charges will be filed against the organization itself this coming week. Shocking as it may seem, prosecutors do often speak to defendants and defense attorneys (most often in white-collar crime cases) about possible crimes and when to expect the charges. It can be part of the negotiating process.
So it appears that criminal charges will come down this week, not against an individual but against the company. In our opinion (and take this with a grain of salt because we’re not practicing criminal law) this can only mean one thing. Prosecutors do not believe that Allen Weisselberg will ever flip. Without Weisselberg’s testimony, it will be extremely difficult, if not impossible, to charge Trump himself on tax fraud. It would be just too hard to prove intent and who wanted what done.
So the next best thing, when it comes to punishing what the prosecutors must surely believe to be criminal behavior, is to blow up the company. Hanging a felony on a corporation can bring about massive fines, it can make it extremely difficult to make new contracts with other companies, get anything financed, and renew little things like liquor licenses that on their own can break things like golf clubs.
Trump must know this because he went off on a crazed rant this morning:
“Radical Left New York City and State Prosecutors, who have let murderers, rapists, drug dealers, and all other forms of crime skyrocket to record levels, and who have just announced that they will be releasing hundreds of people involved in crime back onto the streets without retribution of any kind, are rude, nasty, and totally biased in the way they are treating lawyers, representatives, and some of the wonderful long-term employees and people within the Trump Organization.
And he believes he should be absolved anyway because he did such a great job:
“…Relentlessly seeking to destroy a reputation of a President who has done a great job for this Country, including tax and regulation cuts, Border control, rebuilding the Military, and developing the vaccine in record time—thereby saving our Country, and far beyond. They are a disgrace to our Nation!”
Trump has one valid point that is somewhat sad. When a company is charged, the charges are usually directed at the decision-makers at the highest levels but have the biggest impact on the people who need their wages at the lowest levels, staff level secretaries, inventory people, maintenance, etc. Even the people who aren’t “Trump Organization” employees but possible employees at golf clubs could lose their jobs if the clubs go under unless an angel drops in, to buy the property quickly and keep those employees on.
But that’s the devil’s bargain that it appears Weisselberg has made. Rather than roll on the people most responsible for the crime, he’s going to allow New York to punish everyone. Of course, ironically, with Trump’s cash coming in from lots of directions (including donations now), he will likely be one of the least impacted. The kids on the other hand… losing their birthright??? Well, that’s another story.
