Criminal procedure is nowhere near as complex as civil procedure. In civil cases, one can have their “Fifth Request for Documents and Response to Objection in… ” No, criminal procedure is fairly straightforward. The prosecutors have to provide the defense with a copy of every piece of evidence to be used at trial and enough time to evaluate that evidence. That exchange along with pretrial motions to suppress evidence and scheduling constitutes the vast majority of criminal cases. Usually, hearings are fairly important.

According to Scott McFarlane, far and away the best reporter on the DC District Courthouse beat, a hearing is coming up on Wednesday on the “Oath Keeper Conspiracy.” You will remember that the Oath Keepers were the guys that had 19 phone calls between the top dogs on January 6th. Clearly, they had a plan and it wasn’t about meeting at IHOP.

That is interesting enough in and of itself. But these are also the guys associated with Roger Stone. According to the New York Times:

At least six people who had provided security for Roger Stone entered the Capitol during the Jan. 6 attack, according to a New York Times investigation.

Videos show the group guarding Mr. Stone, a longtime friend of former President Donald J. Trump, on the day of the attack or the day before. All six of them are associated with the Oath Keepers, a far-right anti-government militia that is known to provide security for right-wing personalities and protesters at public events.

We are going to go out on a limb and say that – in our opinion, we’re speculating – that if these guys were talking to Roger Stone within two weeks prior to January 6th, then Trump was in on planning the January 6th riot. Roger Stone is the one witness that many in the media are convinced could’ve tied Trump to Wikileaks, Russian activity, all of it. If Stone was involved in the plan to raid the Capitol, then Trump knew that there was a plan to raid the Capitol. That is our informed presumption, unproven.

Watch this case because the more heat and pressure applied to the Oath Keepers, the more likely they will find themselves wanting to make a deal and simplify their process that much more.
