Assault in the third degree; penalty.
(1) A person commits the offense of assault in the third degree if he:
(a) Intentionally, knowingly, or recklessly causes bodily injury to another person; or
(b) Threatens another in a menacing manner.
(2) Assault in the third degree shall be a Class I misdemeanor unless committed in a fight or scuffle entered into by mutual consent, in which case it shall be a Class II misdemeanor.

If you are not following @RexChapman on Twitter, you are missing out. Chapman is an ex-collegiate and professional basketball star who fought some demons to get out to the other side a very caring, sweet, man who also has a razor-sharp wit and a huge following on Twitter for, well – being a sweet guy with razor-sharp wit. He also seems to have some good legal instincts.
If the MAGAs insist upon believing that COVID is some political hoax, then there’s damn near nothing we can do about it and, in fact, we’ve published pieces in which we’ve been arguing that the MAGAs seem to enjoy “triggering” the libs by denying the obvious right in front of their faces. After all, they got to do it all the time under Trump and we’re all in agreement that they loved the sport.
But it crosses a huge line when that belief becomes acting out in rage over being asked to follow society’s guidelines and rules concerning masks. Politely declining while respecting someone’s distance – six feet and over – is dicey enough, then just as politely leaving if asked to do so is one thing, but walking around coughing on people while arguing about leaving is so far out of bounds that, well, see above and the definition of a crime.

Absolutely. That’s not a Karen, that’s a person who should get arrested on misdemeanor assault and a court date. It is “threatening” someone in a menacing manner. People often think you need to hit or touch someone to assault them, No, that’s battery, which is “unwanted touching.” One could debate whether saliva or breath particulates count as a “touching,” but professional prosecutors can figure out how to best handle charges. Calling the police is the least of which should happen.
