Every single one of us that has ever earned a paycheck detests Mr. FICA, who seems to have a good gig, kind of like Putin, taking his share of everything we earn. It hurts. For many people, it hurts a lot, too much.
Many of those hurt people end up on juries. Rich people always find a way to wiggle out of jury duty, leaving high school teachers, USPS employees, receptionists, etc.
In other words, the juries are generally stuffed with people who live off paychecks and aren’t happy with Mr. FICA, themselves.
When these juries hear that very rich people don’t have to pay FICA (because they make their money off capitol gains, at a far lower rate), and then hear that the rich cheat even when the system is set up for them, a few of them get pissed off.
No one knows this better than Preet Bharara, former U.S. Attorney for SDNY, fired by Trump. He had some thoughts: Tweet Below
“The law is fairly clear on what is income & what is taxable. He’s a sophisticated executive; mistake is implausible. The company booked much of it as income. And juries hate rich tax cheats.”
This is especially true because a necessary part of the trial is submitting evidence as to just how easy it is for the rich to legally write off tax liability, something most of us cannot do. That infuriates juries plenty. But upon hearing that one couldn’t even abide by that law?
Then they get angry. And despite all the instructions about being dispassionate, looking at facts, applying the law, etc. etc., a defendants really don’t want their fate decided by a jury that is furious.
